Is Surrogacy Legal In Florida?
Yes. Florida is a surrogacy-friendly state with specific statutory law authorizing gestational surrogacy. The surrogate carries no parental rights or responsibility. Parties must enter a written agreement before the pregnancy begins, and once pregnancy occurs no party may withdraw regardless of circumstances.
Who Becomes A Gestational Surrogate?
Typically women between 21–40 years old who have had at least one uncomplicated prior pregnancy, are in good health with a healthy BMI, non-smokers, financially stable, and free of criminal or mental health history. The most important thread: a genuine desire to help a family.
Is The Gestational Surrogate Screened?
Absolutely. Heart of Surrogacy conducts an initial pre-screening, followed by criminal background checks, reference interviews, medical documentation review, a potential in-home visit, psychological evaluation by a licensed clinician, and medical screening by the fertility physician to confirm a match.
Will I Have My Own Attorney?
Yes. Every surrogate is represented by independent legal counsel. Attorney fees are covered by the intended parents — you pay nothing for your legal representation.
